Lausanne, May 22, 2013 -The Court of Arbitration for Sport (CAS) has rendered its decision in the appeal
filed by Japanese hammer thrower Koji Murofushi and the Japanese Olympic Committee
(JOC) against the International Olympic Committee (IOC) concerning the decision of August 11, 2012
of the IOC Executive Board to withdraw Mr. Murofushi's candidacy for the elections
to the IOC Athletes’ Commission.
On September 3, 2012, Mr. Murofushi and the JOC filed an appeal before the CAS requesting
the annulment of the decision of the IOC Executive Board. The arbitration was conducted by a
Arbitral panel composed of Professor Ulrich Haas (Germany), President, Mr. Jeff Benz
(United States) and Dr Hans Nater (Switzerland). The parties, as well as their representatives and witnesses have
were heard during a hearing held on April 10 and 11, 20133 at the CAS headquarters in
Lausanne.
The CAS Panel rendered its decision without reasons. The referees informed the Secretary
general of the CAS that they will render the arbitral award with the reasons in a few days and have
indicated that they had unanimously noted that the main reason justifying the confirmation of
the IOC's decision was linked to the fact that the JOC had not respected the applicable regulations.
The referees also noted that Mr. Murofushi's reputation and sportsmanship were
intact.
On March 15, 2013, the CAS rejected the appeal of another candidate to the Athletes' Commission of the
CIO, Mr. Mu-Yen Chu.
